Gazette, Extraordinary, Part 4, Section (Kha), dated 19.10.2016, pp. 7-12. – In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Subordinate Educational (Trained Graduates Grade) Service Rules, 1983. 1.Short title and commencement.- (1) These rules may be called the Uttar Pradesh Subordinate Educational (Trained Graduates Grade) Service (Fourth Amendment) Rules, 2016. (2) They shall come into force at once. 2.Amendment of Rule 3.- In the Uttar Pradesh Subordinate Educational (Trained Graduates Grade) Service Rules, 1983, hereinafter referred to as the said rules, in Rule 3, for existing clause (a) the following clause shall be substituted, namely – (a) ‘appointing authority’ in respect of the posts of Men’s Branch and Women’s Branch both means the Additional Director of Education (Secondary), Uttar Pradesh, Allahabad. 3.Amendment of Rule 4.- In the said rules, in Rule 4, – (a) for existing sub-rule (1) the following sub-rule shall be substituted, namely- (1) There shall be state cadres both for men and women branches. (b) sub-rule (4) shall be omitted. 4.Substitution of Rule 8.- In the said rules, for existing Rule 8, the following rule shall be substituted, namely – 5.Academic qualification.- A candidate for direct recruitment to the various posts in the service must possess the following qualifications or as specified by the Government from time to time – (1) Assistant Teacher (Men/Women) Social Science (i) Bachelor’s degree with at least any two of the subjects amongst the subjects History, Geography, Political Science and Economics from a recognised University in India. (ii) B.Ed. or equivalent degree from a recognised University in India. (2) Assistant Teacher (Men/Women) English(i) Bachelor’s degree with English literature from a recognised University in India or an equivalent degree recognised by the Government.(ii) B.Ed. or equivalent degree from a recognised University in India.(3) Assistant Teacher (Men/Women) Mathematics(i) Bachelor’s degree with Mathematics as one of the subjects from a recognised University in India.(ii) B.Ed. or equivalent degree from a recognised University in India. (4) Assistant Teacher (Men/Women) Science(i) Bachelor’s degree with Physics and Chemistry as subjects from a recognised University in India or an equivalent degree recognised by the Government.(ii) B.Ed. or equivalent degree from a recognised University in India.(5) Assistant Teacher (Men/Women) Biology(i) Bachelor’s degree with Zoology and Botany from a recognised University in India or an equivalent degree recognised by the Government.(ii) B.Ed. or equivalent degree from a recognised University in India.(6) Assistant Teacher (Men/Women) Hindi (i) Bachelor’s degree with Hindi as a subject from a recognised University in India and Intermediate with Sanskrit as a subject or equivalent examination with Sanskrit.(ii) B.Ed. or equivalent degree from a recognised University in India.(7) Assistant Teacher (Men/Women) Sanskrit(i) Bachelor’s degree with Sanskrit as one of the subjects from a recognised University in India or an equivalent degree from a University recognised by the Government. (ii) B.Ed. or equivalent degree from a recognised University in India.(8) Assistant Teacher (Men/Women) Urdu (i) Bachelor’s degree with Urdu as one of the subjects from a recognised University in India or equivalent degree from a University recognised by the Government. (ii) B.Ed. or equivalent degree from a recognised University in India.(9) Assistant Teacher (Men/Women) Persian(i) Bachelor’s degree with Persian as one of the subjects from a recognised University in India.(ii) B.Ed. or equivalent degree from a recognised University in India.(10)Assistant Teacher (Men/Women) Arabic (i) Bachelor’s degree with Arabic as one of the subjects from a recognised University in India. B.Ed. or equivalent degree from a recognised University in India.(ii) B.Ed. or equivalent degree from a recognised University in India.(11)Assistant Teacher (Men/Women) Pali, Gujrati, Punjabi, Bangla, Marathi, Assamese, Uriya, Kannad, Kashimiri, Sindhi, Tamil, Telgu, Malayalam and Nepali.(i) Bachelor’s degree in the related subjects from a recognised University in India. (ii) B.Ed. or equivalent degree from a recognised University in India. (12)Assistant Teacher (Men/Women) Arts (i) Bachelor’s degree with Art subject or Fine Arts from a recognised University in India.(ii) B.Ed. or equivalent degree from a recognised University in India.(13)Assistant Teacher (Men/Women) Physical Education(i) Bachelor’s degree from a recognised University in India. (ii) B.P.Ed. or B.P.E. degree from a recognised University in India.(14)Assistant Teacher (Men/Women) Music (i) Bachelor’s degree with Music as a subjects from a recognised University in India.or (i) Bachelor’s degree from a recognised University in India with Sangeet Visharad from Bhatkhande Sangeet Maha VidyalayaorSangeet Prabhakar from Prayag Sangeet Samiti, Allahabad.Note. – No quality points shall be allocated for Sangeet Visharad or Sangeet Prabhakar. (ii) B.Ed. or equivalent degree from a recognised University in India.(20)Assistant Teacher (Men/Women) Tailoring(i) Bachelor’s degree in Fashion Designing from a recognised University in India.(ii) B.Ed. or equivalent degree from a recognised University in India.5.Substitution of Rule 14.- In the said rules, for existing Rule 14, the following rule shall be substituted, namely – 6.Determination of vacancies- The appointing authority shall determine the number of subject-wise vacancies of Men’s and Women’s Branches both to be filled during the course of the year of recruitment as also the number of vacancies to be reserved for candidates belonging to Scheduled Castes, Scheduled Tribes and other categories under Rule 6. 7.Substitution of Rule 15.- In the said rules, for existing Rule 15, the following rule shall be substituted, namely – 8.Procedure of direct recruitment- (1)(a) The appointing authority shall advertise the number of subject-wise vacancies to be filled by direct recruitment of both branches (Men/Women) as also the number of vacancies to be reserved for candidates belonging to Scheduled Castes, Scheduled Tribes and other categories. The vacancies shall be notified in the following manner – (i) by issuing advertisement in two daily newspapers having wide circulation; (ii) by pasting the notice on the notice board of the office/offices or by advertising through Radio/Television and other Employment newspapers; and (iii) by notifying vacancies to the Employment Exchange. Note. – (1) In the advertisement, besides other things, minimum educational qualifications, pay and allowances and such other relevant information regarding the posts which is considered necessary shall be mentioned. Note. – (2) The applications for direct recruitment shall be invited online on such format as prescribed by the Government. (b) The applications to be invited online under clause (a) shall be obtained on or before the date fixed in the advertisement issued under clause (a). (c) The application in the format mentioned in clause (a) shall include the following (i) The amount of fee as decided by the Government for different categories of candidates in the manner prescribed by the Government, (ii) Self-addressed envelope, and (iii) Other required documents. (d) The applications which are not on the prescribed format or incomplete or contain errors shall not be considered. (2) The appointing authority shall scrutinize the applications and prepare lists of eligible candidates on the basis of the quality points specified in Appendix ‘U. The appointing authority shall place the list so prepared along with the applications before the Selection Committee. (3) For the purpose of selection by direct recruitment, there shall be constituted a selection Committee comprising: (i)Appointing Authority-Chairman(ii) Joint Director of Education (Women) Uttar Pradesh-Member (iii)Joint Director of Education (Finance) Uttar Pradesh -Member Note. – Nomination of officers for giving representation to the Scheduled Castes/Scheduled Tribes and Other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under Section 7 of the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994, as amended from time to time. (4) The Selection Committee shall after considering the cases of candidates on the basis of lists referred to in sub-rule (2), prepare subject-wise lists of selected candidates for appointment in order of merit as disclosed by the quality points compiled under sub-rule (2). If two or more candidates obtain equal quality points, the candidate senior in age shall be placed higher in the list. The Selection Committee shall forward the lists to the appointing authority. 7.Amendment of Rule 16.- In the said rules, in Rule 16, for existing sub-rule (1) the following sub-rule shall be substituted, namely – (1) Recruitment by promotion shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994, as amended from time to time. Notwithstanding anything to the contrary contained in the Uttar Pradesh Constitution of Departmental Promotion Committee for Posts Outside the Purview of the Service Commission Rules, 1992, the Selection Committee shall be constituted as follows: (i)Appointing Authority-Chairman(ii) Joint Director of Education (Women) Uttar Pradesh-Member (iii)Joint Director of Education (Finance) Uttar Pradesh-Member Note. – Nomination of officers for giving representation to the Scheduled Castes/Scheduled Tribes and other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under Section 7 of the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and other Backward Classes) Act, 1994, as amended from time to time. 8.Substitution of Rule 22.- In the said rules, for existing Rule 22, the following rule shall be substituted, namely – 9.Scale of pay.- (1) The scale of the pay admissible to persons appointed to the various categories of posts in the service shall be such as may be determined by the Government from time to time.
