प्रबंधन समिति या जिला विद्यालय निरीक्षक द्वारा उस पद के लिए कोई अनुरोध नहीं भेजा

याचिकाकर्ता ने उसी संस्थान में पोस्टिंग का दावा किया है जहां वह एक एडहॉक शिक्षक के रूप में पढ़ा रहा था। बोर्ड द्वारा उनका चयन संजय सिंह और अन्य के मामले में माननीय सर्वोच्च न्यायालय के निर्णय के अनुसरण में नहीं है। बनाम यूपी राज्य और अन्य; 2016 की सिविल अपील संख्या 8300, निर्णय दिनांक 07.12.2021 को उक्त निर्णय के अंतर्गत आने वाले शिक्षकों को लाभ देते हुए लेकिन उनका चयन 2021 में जारी विज्ञापन के अनुसरण में खुले बाजार के आधार पर किया गया है।
याचिकाकर्ता के उसी संस्थान में पदस्थापन के दावे को खारिज कर दिया गया है। इसी तरह का एक मुद्दा इस न्यायालय के सामने आया था, जो कि 2022 के रिट ए नंबर 1411 द्वारा 14.03.2022 को तय किया गया था।
इसके अलावा, आक्षेपित आदेश में कहा गया है कि, वास्तव में, प्रबंधन समिति या जिला विद्यालय निरीक्षक द्वारा उस पद के लिए कोई अनुरोध नहीं भेजा गया था जिस पर याचिकाकर्ता संस्था में कार्यरत था - राम बाबा विद्या मंदिर इंटर कॉलेज, राम बाबा, अम्बेडकर नागर, इसलिए, बोर्ड के विद्वान वकील श्री ऋषभ त्रिपाही का कहना है कि यदि पद के लिए कोई चयन नहीं हुआ था, तो याचिकाकर्ता को कैसे तैनात किया जा सकता है कि याचिकाकर्ता के वकील का कहना है कि मांग भेजी गई थी लेकिन कोई चयन नहीं हुआ था। यह शायद ही स्थिति में सुधार करता है।
बोर्ड केवल चयनित उम्मीदवारों का पैनल भेज सकता है और एक संस्थान आवंटित कर सकता है जहां उस संस्थान से संबंधित किसी भी रिक्ति को न केवल विज्ञापित किया गया है बल्कि चयन भी किया गया है।
आक्षेपित आदेश में हस्तक्षेप की आवश्यकता नहीं है।
याचिका खारिज की जाती है।

The petitioner claims posting in the same very Institution where he was teaching as an adhoc teacher. His selection by the Board is not in pursuance to the decision of Hon’ble the Supreme Court in the case of Sanjay Singh and ors. vs. State of U.P. and Ors; Civil Appeal No. 8300 of 2016, judgment dated 07.12.2021 by giving benefit for Teachers covered by the said judgment but his selection is on the basis of open market in pursuance to the advertisement issued in 2021.
The claim of the petitioner for posting in the same Institution has been rejected. A similar issue came up before this Court vide Writ A No. 1411 of 2022 decided on 14.03.2022.
This apart, the impugned order says that, in fact, no requisition was sent by the Committee of Management or the District Inspector of Schools for the post on which the petitioner was working in the Institution – Ram Baba Vidya Mandir Inter College, Ram Baba, Ambedkar Nagar,� therefore, Mr. Rishabh Tripahi, learned counsel for the Board says that if no selection was held for the post, how the petitioner can be posted to which counsel for the petitioner says requisition was sent but no selection was held. This hardly improves the situation.
The Board can only send the panel of selected candidates and allocate an Institution where any vacancy pertaining to that Institution has not only been advertised but selection has also been made.
No interference is called for in the impugned order.
The petition is dismissed.
